The California federal court is closer to dismissing the criminal charges against Bitcoin (BTC) advocate Roger Ver, who is often referred to as "Bitcoin Jesus."

On Tuesday, the U.S. government submitted a proposed order to Judge Michael Fitzgerald of the California Central District Federal Court, requesting to dismiss the charges against Ver without prejudice.

The government stated that it has reached an agreement with Ver to pay $49.9 million and to pay "all taxes, penalties, and interest" on his Bitcoin holdings to the Internal Revenue Service (IRS).

This proposed dismissal comes after the U.S. government submitted a deferred prosecution agreement in September, which outlined the conditions under which Ver's case would be dismissed. Ver acknowledged that he was required to file statements and pay taxes on certain crypto assets before renouncing his U.S. citizenship in 2014.

The initial indictment filed in April 2024 accused Ver of making false reports on tax forms related to approximately 131,000 BTC he controlled, which were valued at $74 million in 2014. The U.S. Department of Justice stated that Ver attempted to evade taxes on his assets by renouncing his U.S. citizenship and later becoming a citizen of Saint Kitts and Nevis.

"As the defendant acknowledges, when he filed his tax returns in May 2016, those returns 'did not report all ownership of these Bitcoins nor did they report all capital gains presumed from the sale of these Bitcoins,' resulting in a loss of $16,864,105 to the United States," the motion to dismiss stated on Tuesday.

Although the proposed motion to dismiss has not yet been approved by a federal judge as of this writing, Ver's attorney did not object, and the fact that an agreement was reached with the prosecutors suggests that the criminal case is nearing its conclusion.

Despite the progress in court on Tuesday, bets on prediction platforms Polymarket and Kalshi regarding Ver receiving a pardon from U.S. President Donald Trump still exist, offering odds of 17% and 19%, respectively. Polymarket's terms state that bets will only be resolved if Ver receives "a presidential pardon, commutation, or reprieve from Donald Trump" by December 31.

During the criminal case in January, Ver made a public request to Trump, claiming to be a victim of a "legal war."
