Samourai Wallet co-founder lawyer claims that US prosecutors concealed key information from the US Treasury Department's Financial Crimes Enforcement Network (FinCEN) regarding "no MSB license required" before filing charges. As early as October 2023, FinCEN had informed the prosecution that Samourai did not hold the user's private key and therefore did not constitute a money service business (MSB), but this information will not be available until April 2025
