The times have really changed. During the Biden administration, the SEC refused to state whether Ethereum is a security or not due to its conversion to POS. The new SEC has issued an article defining three types of POS behavior as not belonging to securities. Self pledge, self custody pledge through a third party, and custody pledge are not securities. However, further pledging restaking requires separate analysis, as POS tokens are not mentioned.
