Ok, Roman Storm was found guilty of only one count of the three brought against him. Disappointment but not despair. The good: - He will not be going to jail right now - bail upheld - through the prosecution tried really hard to imprison him immediately after the verdict today - Not found Guilty on the worst charges (w/ 45 yr max sentence) - He will have opportunity to appeal the guilty count and the next court may have more favorable judge The bad: - He was found guilty on USC 1960 Conspiracy to operate unlicensed money transmitting business (up to 5 years) - Jury was convinced that developing Tornado Cash protocol and front-end was enough to be guilty of money laundering The ugly: - Verdict means all crypto DeFi and privacy developers are still at risk, probably increased risk as a result of the USDC 1960 guilty precedent in this first court decision My take: Unlikely the DOJ will hunt down further privacy developers under the current administration but also the chilling effect is still very high for DeFi and crypto and this verdict makes it slightly worse. The precedent from this first verdict is bad. That said the story isn't finished. We did put some points on the board. The appeal case will happen and the next trial will be critical. Crypto can still fully win. If this were a basketball game I'd say Anti Crypto Army is up by 12 points going into the second half. It's going to be a close game.
