The Texas reps made a *HUGE* mistake here as this isn’t just regular intimidation. It tips into kidnapping and federal violations. They feel protected by the Trump DoJ and Texas AG, but a one detail means there is *NO* statute of limitation. It violates Texas kidnap laws but becomes Federal because of: -8 U.S.C. § 242: Deprivation of Rights: Acting under the color of law (using state authority in this case) to deprive someone unduly of their rights, including the 14th amendment (incl freedom of movement) is a federal crime. To detain someone must always follow proper criminal charges and fair trial, otherwise you can’t use federal authority to deny them rights. -18 U.S.C. § 241: Conspiracy against Rights: Two or more persons conspire to deprive rights -18 U.S.C. § 245(a)(1)(F): Makes illegal by force or by threat, to interfere with the ability of a state employee (including legislature) to perform their duties. -18 U.S.C. § 245(a)(1)(E): Makes it illegal by force or threat to interfere with the regular use of a public building (including the right to leave it) -42 U.S.C. § 1983: Allows her to file these as civil claims as well and sue Texas on kidnapping. So technically the DoJ and FBI should be involved here, even though they likely won’t due to political bias. BUT: -They made a *huge* mistake: Normally the Statute of Limitations for interference in Texas is 2 years, and the federal crime inherits the state Statute of Limitations UNLESS it involves: -death -bodily harm -people under the age of 18 OR: -kidnap Detaining someone unlawfully means there is *NO* statute of limitations. @NicoleCollier95 is free to pursue Texas civil charges for 2 years, but she may request the DoJ pursue criminal charges against *every single person* involved in her detainment from lawmakers, to the AG and Governor (for failure to act), to the sergeant at arms (for enforcement), for years to come. That means even if Pam Bondi won’t enforce the law, Rep Collier can wait until the next federal administration takes power to pursue justice. She should use every single legal avenue to do so. Our political reps, left or right, should not ever face threat, harm or detainment, for doing what they think is right for their constituents. So in a twisted way, thank you to the dumb Texas house Republican reps who crossed the line just enough to ensure Ken Paxton and Greg Abbott, now have legal exposure to federal crimes with no statute of limitations!(Adam Cochran (adamscochran.eth))
