The US judge requests clarification on Do Kwon's potential sentence in South Korea and concerns about judicial risks in multiple countries before sentencing Odaily Planet Daily News: Do Kwon, co-founder of Terraform Labs, will be sentenced in New York on Thursday, having previously pleaded guilty to two serious charges (wire fraud and conspiracy to commit fraud). Before sentencing, US federal judge Paul Engelmayer requested that both the prosecution and defense clearly state the charges that Kwon will face in South Korea and his "maximum and minimum sentences" to assess his multinational judicial risks. According to court documents, the judge wishes to know whether South Korea may release Kwon earlier if he is extradited back to his home country after completing his sentence in the United States, and how his detention time in South Korea will be calculated. Kwon's lawyer said that if he is extradited to South Korea, he will re-enter the pre-trial detention stage, and if convicted, he could face up to 40 years in prison. The document also states that the judge asked both parties if they agreed to exclude the "four months Kwon served in Montenegro" from the US sentence to avoid the issue of overlapping sentences across jurisdictions. Kwon was detained in Montenegro at the time for using forged travel documents and defended multiple extradition requests there for over a year. The US prosecutor demands a minimum sentence of 12 years in prison and claims that the scale of the losses caused by it exceeds the combined total of SBF, Mashinsky, and OneCoin's head Greenwood. The defense suggests a sentence of no more than 5 years. Do Kwon disappeared after the Terra crash in 2022 and was arrested in Montenegro in 2023. Both South Korea and the United States have filed charges against him, and it is expected that he will face further detention and trial in South Korea after serving his sentence in the United States. The judge will make a preliminary sentencing decision on Thursday, but the cross judicial nature of the case means it will continue to advance in the coming years. (Finance Feeds)
