The US Supreme Court is about to rule on the Trump tariff case
Odaily Planet Daily News: The US Supreme Court will soon rule on whether the global tariffs imposed by the Trump administration under the International Emergency Economic Powers Act are legal. If the ruling is invalid, importers may engage in a potential struggle to obtain up to $150 billion in paid tariff refunds from the US government. The core challenge lies in the uncertainty of the refund process: even if successful, businesses generally expect the Trump administration to delay or refuse refunds. Although the US Customs has announced the implementation of an electronic refund system, the fully automated process has not yet been clarified. In order to lock in equity in advance, several large importers, including Costco, have initiated preventive lawsuits, while small and medium-sized enterprises have sold their refund rights to hedge funds in the secondary market at extremely low discounts (a few cents to one dollar). Experts suggest that companies should immediately organize and verify detailed records of all paid tariffs, and be prepared to apply for refunds in accordance with the law as soon as possible after the ruling, in order to cope with complex legal and administrative procedures that may last for several years.
