Day 3 of the trial: Musk submits more evidence against OpenAI.
Back in 2015, OpenAI founder Sam Altman emailed Musk, pleading for him to commit $100 million in donations to OpenAI, and asked if he could donate $30 million over the next five years.
In the end, Musk donated a total of $38 million and even covered office rental costs.
After Musk left OpenAI’s board two and a half years later to focus on Tesla and SpaceX, OpenAI came back asking him for more money.
On July 22, 2020, OpenAI’s CFO emailed Musk’s team, saying the company was on the verge of collapse and asked if Musk could cover OpenAI’s office rent and security expenses.
Musk agreed again and paid the rent for OpenAI.
According to California law, when a charitable organization solicits and accepts donations, a fiduciary relationship is established between the fundraiser and the donor.
Sam Altman and the CFO repeatedly solicited donations from Musk, and Musk donated. OpenAI accepted the donations.
Then, without notifying Musk, they suddenly turned this charitable organization into a for-profit company valued at $852 billion and prepared to go public.
They then claimed that the OpenAI Musk had donated to was a charity, and the current OpenAI, with its new structure, is a completely different entity—just coincidentally sharing the same name.
Musk was betrayed.
